Should the ownership of goods be transferred when goods in bonded areas are transported into free-trade-zone enterprises? How can one ensure the ownership of goods?

According to current regulations, the transfer of ownership is optional for goods in bonded areas to be transported to free-trade-zone enterprises. If there is no transaction between a bonded zone business entity and a free-trade-zone enterprise, the free-trade-zone enterprise shall file the following information in both “Marks” and “Consignee Code” columns of the customs declaration:

  1. If the ownership of goods belongs to a domestic buyer (or the above-mentioned bonded zone business entity): Fill in the column of “Marks” with “This batch of goods is reported for storage by (xxx) free-trade-zone enterprise on behalf of (xxx) domestic company”. In addition, the business registration number of the domestic buyer (or the above-mentioned bonded zone business entity) shall be fill in the column of “Consignee Code”.
  2. If the ownership of goods belongs to a foreign buyer: Fill in the column of “Marks” with “This batch of goods is reported for storage by (xxx) free-trade-zone enterprise on behalf of (xxx) foreign company”. In addition, the code of the foreign buyer (FFF plus free-trade-zone enterprise Customs Control Code) of a foreign manufacturer shall be fill in the column of “Consignee Code”. 

As for the ensurance of ownership by the goods' owners, which is a relationship between the free-trade-zone enterprises and goods' owners governed by private laws, Customs will not intervene.
