Based on “Regulations Governing Customs Measures in Protecting the Rights and Interests of Trademark,” a right holder of a registered trademark could advise Customs with information (descriptive and visual) about whether unspecific goods are suspicious of infringing on his/her trademark rights. The application of the advice should be submitted online through Single Window Portal with the following information:
1. Descriptions on characteristics of the genuine and the counterfeit goods.
2. Electronic image files to identify the defining characteristic of genuine goods and infringing goods, (for example, photos or catalogue of genuine goods, counterfeit goods or a comparison between both) and the images should be the designated goods of the registered trademark.
3. Registered trademark certificate. In a case where the advice is made by an agent, documents of authorization shall be submitted.
4. Contact information, such as address and phone/mobile number of the proprietor (or his/her agent) in Taiwan.
