What are the procedures for right holders to apply for trademark protection to Taiwan Customs?

In order to protect the rights and interests of trademark owners, Taiwan Customs has enforced “Regulations Governing Customs Measures in Protecting the Rights and Interests of Trademark”. According to the regulations, the right holders shall make a written complaint to the Customs Administration or the relevant field Customs for the imported or exported goods which are suspected of infringing on trademark right. The following information shall be submitted when making a complaint:
1. The fact of infringement and the sufficient description to identify the infringing goods. The proprietor of a registered trademark should also provide related data in electronic file, such as sample, picture, catalogue or photo of the genuine goods and counterfeit goods.
2. Related specific data such as names of the exporter/importer, name of the goods, import/export ports, date, number of flight or ship, number of container, storage venue of the goods.
3. Registered trademark certificate (The applicant shall note “Verified Correct with the Original” with signature or stamp on the photocopy of said certificate). In the event that a complaint is made by an agent, documents which prove the existence of agency shall be submitted.
Besides, the right holders shall also submit the data mentioned in Item 1 and Item 3 to the Customs Administration or field Customs as advice to assist in making identification.
