Kaohsiung Customs stated that the "Huang Fei Hong Peanuts", a popular snack produced in Mainland China, is classified under tariff number 2008.11.92.00-4, subject to the import regulation codes MW0 (Importation of Mainland China products is prohibited.) and F01 (The importer shall apply for inspection to Food and Drug Administration.). To protect our domestic industries, the importation of "Huang Fei Hong Peanuts" produced in Mainland China is currently prohibited unless approved by the International Trade Administration, Ministry of Economic Affairs (TITA), and no special approval cases have been granted. In other words, the peanuts from Mainland China on sale in the market are considered illicitly imported goods. In addition to penalties such as confiscation of goods or fines under the Customs Anti-Smuggling Act, the violators may be transferred to the TITA for sanction under the Act Governing Relations between the people of the Taiwan Area and the Mainland Area.

Kaohsiung Customs further clarified that under the Attachment to Article 4, Paragraph 2 of the Regulations Governing the Declaration, Inspection, Duty, and Release of Personal Luggage or Goods of Inward Passengers, the quantity of peanut snacks carried by inbound passengers shall not exceed 1 kilogram. Additionally, they must be for personal use only and not for resale or profit. 

Kaohsiung Customs urges the public not to buy or sell restricted products across border. Before importing, traders can inquire TITA or visit its website (https://fbfh.trade.gov.tw/fh/ap/queryCCCRegFormf.do) to verify whether the goods are permitted for import, in order to avoid legal violations and penalties.
